With part of the world still heavily affected by the COVID-19 pandemic, IP Australia has extended the time available for requesting free streamlined extensions of time until 31 March 2021. Under the streamlined extensions provision a supporting declaration is not required to get an extension of time if you are unable to meet a patent deadline due to effects of the COVID-19 pandemic on you, personally or your business, for example.

For patents, the streamlined extensions are not available for time periods that are usually not extendible via provisions under Section 223 of the Patents Act.

After the streamlined extensions of time are over, extensions due to the effects of COVID-19 will be available and decided on a case-by-case basis.

If COVID-19 has affected your or your client’s ability to meet a patent deadline in Australia or if you have any questions about extensions of time, feel free to contact one of our attorneys at Baxter IP.
