Registrability

If you are planning to file a trade mark application we would recommend that you have a registrability search carried out first in order to obtain an indication of whether there are any third party trade marks that might conflict with your application and so whether your trade mark application is likely to be allowed.

  • Trade Mark Registrations Search involves searching IP Australia’s trade marks database and International trade mark registrations in the relevant classes
  • Full Availability Search additionally involves searching a variety of different sources to attempt to locate any relevant unregistered trade marks

 

Strategic

Trade Mark searching may be conducted for strategic business purposes, such as to:

  • Highlight industry trends
  • Identify competitor initiatives
  • Assess the value of a trade mark portfolio
  • Identify potential infringers
